Terms and Conditions
1. Acceptance of Terms
You acknowledge & warrant to Tour Adventures NZ Ltd, that you have accessed, read & accept these terms by making a booking with Tour Adventures NZ Ltd.
2. Bookings will be confirmed and held on receipt of a full payment. Rates quoted are in New Zealand dollars and excludes a Goods and Services Tax when booked off shore.
A Good & Service Tax of 15% is only payable when bookings are made within New Zealand.
3. Credit Card details will confirm your booking. Your credit card will be charged 100% of the tour price and your place(s) reserved as soon as your details have been submitted. For bookings made 30 days or less prior to travel, full payment is required at the time of booking. Our online booking system is safe and secure and a receipt will be issued immediately.
+ 30 days prior to tour = 10% charge of the total tour price.
Within 29 - 14 days = 20% charge of the total tour price.
Within 13 - 3 days = 50% charge of the total tour price.
Within 2 - 0 days = 100% charge of the total tour price (or no show)
All tours may be extended or amended, provided that these arrangements are made more than 15 days prior to departure.
5. Travel insurance
Tour Adventures New Zealand Ltd highly recommends that you purchase your own comprehensive travel insurance at the time of booking.
Comprehensive travel and cancellation insurance to cover cancellation, medical treatment, hospitalization for illness, loss of or damage to your personal property.
Cancellation fees charged by Tour Adventures New Zealand Ltd will not be waived under any circumstances where travel insurance may have covered you.
Each passenger traveling on escorted Motor coach tours is allowed one piece of checked baggage per person due to space limitations. Additional luggage will be charged at $10 per person per day. We recommend that passengers inform us ahead of time if they decide on bringing extra checked baggage. This way our tour escort is aware of this and we have an idea of how many bags
will need to be transported additionally. Please note that there will be sufficient space for some extra luggage on the coach however if every passenger would bring an extra bag, this would certainly cause space problems, especially if the tour is fully booked.
Due to the nature of this holiday, bags are handled many times, so a durable and clearly labeled bag is required. A special luggage tag will be issued and should remain on your bag at all times to help ensure the bag is delivered to, and retrieved from, the hotel room at each destination. We cannot assume liability for damaged or lost luggage. Passengers must, therefore, ensure that they have luggage that is reasonably sturdy. In addition, passengers should carry adequate travel insurance which also covers lost or damaged luggage.
7. Accident Compensation Scheme
You acknowledge that New Zealand has a no fault law and claims are handled by the Accident Compensation Commission (“ACC”) pursuant to governing legislation, including the Accident Compensation Act Because of the wide range of help available from ACC after an injury, you can’t sue for personal injury in New Zealand, except for exemplary damages. Should you require additional cover outside that provided by ACC, then you should organise your own Insurance cover direct. Tour Adventures New Zealand Ltd is not obliged to take out any such additional cover on your behalf.
8. Holiday Duration The first and last day of your holiday itinerary are travelling days and therefore depending on flight arrival / departure times, may not necessarily be whole days.
9. Special requests
Please advise Tour Adventures New Zealand Ltd of any special needs or requests at the time of booking. We will endeavour to meet such needs or special requests, but cannot guarantee that they will be, nor will we be responsible if any are not met. If you have any medical conditions or disabilities which may affect your travel arrangements, we need to be advised in writing at the time of booking. If we cannot accommodate your needs or requirements, we will advise you at that time.
New Zealand has very strict quarantine regulations. Do not bring any raw food, fruit, plant material or soil with you. There are severe penalties if you do.
Under the provisions of the Smoke Free Environment Act (1990) and the amendment (the Smoke-free Environments Amendment Act 2003), vehicle services are required to be smoke-free. Regular stops are made for passengers’ comfort.
12. Inclusions and exclusions
The Price of your booking shall cover only those items specified by Tour Adventures New Zealand Ltd in writing at the time of your booking (or any variation thereto). Without limitation, unless specified otherwise by Tour Adventures New Zealand Ltd in writing, the Price of your booking shall not cover airport arrival/departure taxes or any other airline fees or charges, travel agent fees and charges, Travel insurance, charges for excess luggage, personal services, gratuities, laundry, drinks, meals, pre-travel documentation, personal accident and medical expenses and incidental expenses including all communication charges, all of which are your sole responsibility.
Additional activities can be included in the tour package or selected on a ‘pay as you go’ basis. Additional activities may require pre-booking.
13. Specialist tours & special events
When treks, bicycle and kayak tours and more specialised products are included in your tour or other travel arrangements, the balance of the Price of your booking shall become due and payable at least 60 days prior to your travel departure date. Where bookings relate to a period in which special events are due to take place in New Zealand, bookings may be subject to additional or varied terms and conditions (including with respect to cancellation policies, deposit requirements, payment and surcharges), as advised by Tour Adventures New Zealand Ltd from time to time.
14. Variations & cancellation by Tour Adventures New Zealand Ltd
Tour Adventures New Zealand Ltd reserves the right to vary any tour or other travel arrangement at any time up to and following your travel departure date. You will be notified promptly of any such variation.
If a variation results in a substantive change to your itinerary (as determined by Tour Adventures New Zealand Ltd), you will have the option of:
(a) continuing with the varied tour or other travel arrangements without a reduction in Price;
(b) accepting any alternative arrangements offered to you by Tour Adventures New Zealand Ltd (in which case any difference in price will be payable by you or refundable by Tour Adventures New Zealand Ltd (as applicable));
(c) purchasing another available holiday from Tour Adventures New Zealand Ltd (in which case any difference in price will be payable by you or refundable by Tour Adventures NZ Ltd (as applicable)); or
(d) cancelling your booking whereby you will be given a full refund of all amounts paid to Tour Adventures New Zealand Ltd in respect of such booking (excluding insurance premiums, Variation Fees and Additional fees (as applicable)), provided that notification of your decision to cancel is received in writing by Tour Adventures New Zealand Ltd no later than 14 days from the date on which Tour Adventures New Zealand Ltd notified you of the substantive change to your itinerary.
(e) Tour Adventures New Zealand reserves the right to cancel any booking due to an unlikely unforseen event of circumstances. You will be notified promptly of any such cancellation.
If cancellation is made prior to the departure of your tour, the responsibility of Tour Adventures New Zealand Ltd is to only refund to the passenger the amount received for the reservation (excluding insurance premiums, Variation Fees and Additional fees) (as applicable)).
(f) Where possible, Tour Adventures New Zealand Ltd will endeavour to re- book the tour for an alternative departure date or a similar tour with a refund for fees applicable to reissuing or changing flights. (Applicable only to tour departure dates) Tour Adventures New Zealand Ltd will not be held responsible or incur any liability for airfares purchased by travel agents or clients online via the internet.
15. MINIMUM PARTICIPATION
Minimum Participation on all Motor coach Tours is 4 passengers. If fewer passengers materialize, we reserve the right to cancel the departure, or operate the departure by van. For small groups, Tour Adventures NZ Ltd reserve the right to operate tours using a minibus or van, (without toilet) comfort stops are guaranteed.
16. Limitation of Liability
Tour Adventures New Zealand Ltd, as operator or agent, completes all tour arrangements on the condition that it shall assume no responsibility or liability for any injury, loss, (Which includes loss or damage to your baggage including personal items) accident, delay or irregularity which may occur either directly or indirectly from any defect in any vehicle, vessel or equipment, or through neglect or default of any company or person engaged in conveying the passengers or carrying out our arrangements of the tours or otherwise in connection with the tours. Further, Tour Adventures New Zealand Ltd is not responsible for medical problems encountered before, during or after the tour, strikes, thefts, force majeure, acts of terrorism, government restrictions or regulations, discrepancies or changes in transit or hotel and other services over which it has no control. No claim may be made against Tour Adventures New Zealand Ltd arising out of the tour and no third party may make a claim against Tour Adventures New Zealand Ltd.
Should any dispute arise between Tour Adventures New Zealand Ltd and any client, such dispute will be governed by the Laws of New Zealand.
You agree to indemnify Tour Adventures New Zealand Ltd for any loss or damage suffered by Tour Adventures New Zealand Ltd as a result of, or in connection with, any breach of these Terms or any negligence or wilful default, by you (or any other person covered by your booking).
Tour Adventures New Zealand Ltd regard our visitors’ privacy as a very important issue. Tour Adventures New Zealand Ltd is concerned about protecting your privacy and is committed to honouring the privacy of its visitors to the website. We will only record your e-mail address if you send us a message. It will only be used for the purpose for which you have provided. We will not use your e-mail address or any of your personal details contained in your e-mail for any other purpose without your consent except for promotional material and newsletters relating to Tour Adventures New Zealand Ltd business and its services.
19. Services and Assistance
If an unexpected problem occurs during your travel arrangements then, in your own best interests, please contact our office without delay. Only by doing this can we take steps to remedy the situation and to help you. If you remain dissatisfied with any complaint, it must be made in writing to us within 30 days. Please include your booking reference numbers and name, as this will help us to respond to you quickly.
These Terms may be subject to amendment by Tour Adventures New Zealand Ltd from time to time.
Additional terms and conditions may apply to your booking and will be advised by your Tour Adventures New Zealand Ltd representative at the time of booking (or variation thereof)
All prices specified in any brochure are gross amounts and, unless agreed by Tour Adventures New Zealand Ltd, no itemised costings will be provided.
You authorise Tour Adventures New Zealand Ltd to contact any source in order to check, exchange or provide information relating to you for the purpose of providing services to you. Tour Adventures New Zealand Ltd will only use the personal information you provide or it obtains from other sources in connection with the provision of services to you. You may request, at any time, to have access to the personal information held by Tour Adventures New Zealand Ltd about you and to request the correction information of that personal information.
All photographs in any brochure produced by Tour Adventures New Zealand Ltd illustrate genuine events and places. Their use or particular positioning should not be interpreted as confirmation that those events and places will necessarily be seen on the relevant tour. Any questions in this regard should be directed in writing to The Manager prior to the finalisation of travel arrangements.
The Terms are governed by the laws or New Zealand and the parties submit to the non-exclusive jurisdiction of the New Zealand courts. These Terms constitute the entire agreement between the parties and about its subject matter and any previous agreements, understandings and negotiations on that subject matter have no effect.
